By creating an account, accessing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

You may only connect a hostname you own or are authorized to use. You handle DNS. We request SSL after we verify the records; we do not guarantee it. The {slug}.sites.everpoint.ca address is our starter host and we can change or remove it. We may refuse or remove a custom host if we cannot verify ownership or it poses a security risk. Domain registrar fees stay yours.
EverPoint provides tools for record-keeping and organization only. You are solely responsible for ensuring your use of the Service complies with all applicable labor laws, employment standards, and tax regulations in your jurisdiction.
Some areas may be in early access, prototype, or evolving states. Features may change, move, or be removed.
4. Accounts, Roles, and Workspace Responsibility
The Service supports multiple user roles (for example, company owner/admin, office/management users, employees, and similar roles).
You are responsible for:
- maintaining accurate account and company information;
- safeguarding credentials and account access;
- ensuring users in your workspace are authorized;
- actions taken through your account or workspace.
You must promptly notify us at admin@everpoint.ca if you believe your account has been compromised.
5. Acceptable Use
You agree not to:
- use the Service in violation of applicable law;
- interfere with or disrupt the Service, systems, or security;

6. Customer Data and Content
Between you and EverPoint, you retain ownership of the data and content you submit to the Service ("Customer Data"), including operational records (for example, customer, job, schedule, and timecard information).
You grant EverPoint a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display Customer Data solely to:
- provide and maintain the Service;
- secure, troubleshoot, and improve the Service;

9. Downloads and Client Software

Use of downloaded client software is limited to your lawful use of the Service under these Terms.
10. Fees, Subscriptions, and Add-Ons
Some features may require paid subscriptions, add-ons, or approved workspace access.
Commercial terms (including pricing, billing cycles, payment timing, taxes, refunds, renewals, suspension for non-payment, and cancellation handling) are governed by your order form, invoice, or separate commercial agreement with EverPoint.
Where no separate commercial agreement exists, default billing terms are:
- Prices are in Canadian dollars. Card payments are processed by Square. EverPoint Solutions does not store full card numbers. Questions about an invoice, a payment or a cancellation? Email billing@everpoint.ca. Payment may also be by Interac e-transfer to billing@everpoint.ca unless an invoice says otherwise. Invoices are due within 30 days. Quotes are valid for 30 days unless the quote says otherwise. Website, document design, and other custom work are billed as quoted. Monthly care or hosting is billed as quoted and may change with notice. EverSeal is in development / testing and is not sold as a paid public subscription under these Terms until a separate order says otherwise.
- Custom work (including websites, document design, and similar): no refund for work already performed. Monthly care or hosting: you may cancel anytime; we refund any unused prepaid period on a pro-rata basis. Domain registration fees are not refundable after we pay the registrar. Software early access is not a paid subscription yet; if we later charge for software, refunds will be in that order form.
11. Service Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
We do not guarantee uninterrupted, error-free, or always-available operation.
12. Suspension and Termination
We may suspend or terminate access (in whole or in part) if:
- you materially breach these Terms;
- we reasonably believe use presents security, legal, or operational risk;
- payment obligations are overdue (if applicable).
You may stop using the Service at any time.
Sections that by their nature should survive termination will survive, including sections on ownership, disclaimers, limitation of liability, indemnity, dispute terms, and general provisions.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

You acknowledge that as a sole proprietorship, this limitation is a fundamental basis of the bargain.
15. Indemnity
You will defend, indemnify, and hold harmless EverPoint and its affiliates, officers, directors, personnel, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- your use of the Service;
- your Customer Data;
- your violation of these Terms or applicable law;
- your infringement of third-party rights.
16. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Dispute venue is the courts of Ontario.
Before starting formal proceedings, each party will attempt to resolve disputes in good faith by written notice to admin@everpoint.ca.
17. Changes to These Terms
We may update these Terms from time to time.
